My son is using his Dad's surname. He acknowledged and signed the birth certificate upon registering the child. We are not married, he is still single but having a girlfriend and 1 daughter and with plans to get married soon, apparently, I am still single and bearing all the expenses of our son. Despite of my repeated verbal demand for child support, he is not communicating and cooperating, instead ignoring my demands. I am living and working in United Arab Emirates and he is currently working and living in Saudi. I would like to know the right process of sending demand letter for child support, and if he refused to liaise with me with this matter, what is the case to be filed against him?

Since your son is a recognized natural child, and his father signed his birth certificate, your son is entitled to receive support from his father.

You can first send a demand letter through registered mail with return card asking for an amount for support. Please note that you and the father will have to split the support for the child in equal shares. So, it would be better if you send him photocopies of the receipt for the child's tuition expenses, doctor's bills, food and clothing, rent, etc. Ask him to pay at least half of that.

Pag ayaw pa, go to a lawyer and have the lawyer send him a letter of demand. Pag hindi pa rin, that's when you can file a civil case for support or a criminal case for nonpayment of support. Talk to a lawyer.

Thank you for your swift reply Atty. Bimbi. When do I have to start the calculation? Is it okay if I will just start last enrollment for SY 2015-2016 up to date including all his expenses since 2015 started? And, when does this Affidavit of Acknowledgment for Father's Surname needed? Since I have plans to bring my son abroad, do I still need the same even though he already signed the original birth certificate? Also, since he is working in a Hotel in Saudi Arabia and I do not have his accommodation/residential address there, can I send the letter to their company/hotel directly where he is currently working? Thanking you in advance.
