Pagpapakasal, divorce in Japan with Japanese, recognized in the Philippines?

2 years na pong divorce ang girlfriend ko na nasa japan,japanese ang ex husband niya at sa japan sila ikinasal. Plano namin magpakasal dito sa pilipinas, hindi pa po siya japanese citizen pero may anak siya sa hapon at nasa custody niya ito. Ano po ang kailangan na documents na ayusin at ipadala dito sa pilipinas para maparecognize ang divorce niya dito at para makapagpakasal na po kami. Magkano kaya ang bayad sa abogado at ilang buwan ang itatagal nito. Maaari po ba na ako ang umasikaso nito dito sa pilipinas habang nagtatrabaho ang girlfriend ko sa japan?


Question: My girlfriend has been divorced from her ex-husband for two years now. Her ex husband is Japanese and they were married in Japan. We plan to get married here in the Philippines. My girlfriend is not yet a Japanese citizen, but she has a child with her Japanese ex-husband, and their child is under her custody. What documents are needed here in the Philippines in order to recognize the divorce of her marriage in Japan? Around how much would it cost for the lawyer/ attorney? Around how long or how many months would it usually take? Can I help my girlfriend take care of all the required paperworks/documentation here in the Philippines, while she is working in Japan?

Your question can be answered depending upon your answer to this question: Iyong bang kasal ng iyong girlfriend doon sa Japanese ex-husband niya ay registered dito sa Pilipinas?

Kasi, kung hindi registered iyong kasal niya doon sa Hapon, sa mata ng batas ng Pilipinas, single pa iyong girlfriend mo (kahit naikasal na siya sa Japan at na-divorce na). Kung sa ilalim ng batas ng Pilipinas, hindi naman naka-rehistro ang kasalan sa Japan (ibig sabihin ba'y wala namang record ang NSO natin na ikinasal ang girlfriend mo) bakit mo pa sasabihin sa NSO na ang girlfriend mo ay divorced na?

Ang pinaka-maganda ay kumuha ka ng CeNoMarr mula sa NSO. Ang cenomar ay isang dokumento (Certificate of No Marriage) na ini-issue ng NSO para mapatunayang walang naka-talang kasal ang iyong girlfriend sa Pilipinas. Makakakuha ka nito kung sasabihin mo sa NSO na ikaw ay boyfriend noong girlfriend mo at nais ninyong magpakasal, iyon nga lang ay hindi ka sigurado kung single nga ba ang iyong girlfriend (huwag mo nang sabihin na kinasal na siya sa Hapon or na siya'y divorced na -- huwag mo nang sabihin iyon.)

Ganito kasi iyon: kung hindi rehistrado ang kasal ng girlfriend mo doon sa Hapon na ex-husband niya, puede kayong mag-pa-kasal sa Pinas dahil dito, single pa siya.

Dito kasi sa Pilipinas, hindi tayo nag-re-recognize ng divorce. Kaya kung naka-tala na sa NSO na ang iyong girlfriend ay married na sa isang Japanese national, kahit na i-divorce pa siya noong Japanese national, sa mata ng batas ng Pilipinas, kasal pa rin siya at hindi na puede pang mag-pa-kasal pa ulit.

Weird ba? Only in the Philippines iyan. Dapat na talagang baguhin ang batas. Kasi, napaka-rami na ng mga inter-cultural marriages na nag-e-end in divorce. Ang anomalous situation, sa ibang bansa, ang Pilipino ay divorced na (dahil sa recognized nila ang divorce) pero, sa atin, ang Pilipino remains married kahit na divorced na siya sa ibang bansa.

Sulatan mo kaya ang iyong congressman at senador para baguhin na nila ang batas?
