Ilang taon po ang minimum years ng petition? 31 years old na ako. In-apply ng mother ko ang petition noong 2010 para tumira sa US. Napadalahan na ako ng letter galing US embassy na wala pa silang available na visa. Maraming salamat po


Translation: How many years is the minimum/maximum years of petition for immigrant visa process? I am now 31 years old. My mother applied to petition me in 2010 to become an immigrant in the United States. The U.S. Embassy sent me a letter stating that there was still no visa available.

I'm not a US immigration attorney. I do have some experience about US immigration, though. Here are some factors that will affect your immigration application:

1. If your sponsor (your mother) is a citizen, generally, there is a higher priority for their petitions than if your mother is just a permanent legal resident (green card holder).

2. If you are not a minor, if you are married then, the priority is low.


Other factors that make US immigration applications problematic at this time include:

1. There is an ongoing controversy about the immigration laws being amended and overhauled.

2. There is a backlog of processing. First, since 9/11, screening is much more thorough and in-depth. Second, there are more people applying for immigration since there are more refugees and displaced persons because of wars and other armed conflicts around the world. Third, there are a lot of immigration application from within the US.

3. Those minor children of illegal immigrants have been granted amnesty until they turn 18. These have added to the already overwhelmed processing system.

4. A lot of those who have been granted green cards are being removed from the US because of misdemeanors and felonies. This also backs up the processing system.
