Two weeks ago tinawagan ako ng kaibigan ng isang kaibigan. Puede ko daw ba siyang tulungan: May kaibigan daw siyang Taiwanese at nangangailangan ng workers for his business. Puede daw bang umalis iyong mga friends din niya na gustong mag-work doon? Kailangan pa daw bang dumaan sa POEA? Bakit daw kailangan pa ng agency napaka-taas naman daw ng singil na placement fee?


Obtaining an employment contract overseas without going through the POEA (Philippine Overseas Employment Administration) is called a ‘direct hire’ or ‘direct employment’. Maaaring it looks more convenient and beneficial kasi wala kang papeles na padadaanin pa sa POEA at wala nang masyadong maraming babayaran. Parang, buntot mo, hila mo, eka nga. Possible bang mag-abroad na direct hire? Possible. Mabuti bang gawin ito? Hindi.


Ipinagbabawal ang mag-facilitate ng pag-alis ng ibang tao to work abroad na direct hire. You need a licensed and authorized deployment agency to deploy you for work overseas. Kung walang lisensiya ang taong mag-de-deploy sa inyo, ‘illegal recruitment’ ang kanyang ginagawa.


Kapag direct hire ka at matanggal ka sa trabaho without just cause habang nasa abroad ka, you are on your own. Kung ide-demanda mo iyong employer mo for the illegal dismissal, you will have to go to the courts in the place where you worked. Ang mga batas na mag-aaply ay iyong batas noong bansa ng employer mo. So, pabor siyempre sa kanila doon. Kapag may-POEA approved contract ka, ang hiring and dismissal mo ay nasa ilalim ng saklaw ng Labor Code ng Pilipinas na pabor sa mga manggagawa.


Kapag naka-uwi ka, kung direct hire ka, wala kang mai-dedemanda para managot sa illegal dismissal (dismissal without just cause) na nangyari sa iyo abroad. Kasi, yung agency dito ang representative noong foreign employer na hindi mo naman mahahabol dahil sa narito ka na sa Pilipinas at na-repatriate ka na. Kung POEA-approved contract ang hawak mo, kung matanggal ka sa trabaho mo abroad at ikaw ay pabalikin sa Pinas, may hahabulin ka pa – yung agency na representative noong foreign employer mo. Sila ang tatayo sa lugar noong employer mo at sila ang sasagot sa anumang damages na nararapat para sa iyo.


So, kung may mag-offer sa iyo ng direct hire. Kunwari, nasa abroad ka na, nag-expire na ang contract mo at may mag offer sa iyo ng bagong contract na hindi na dadaan pa sa POEA, ingat ka. Think first, ask questions. Be informed of the consequences of working under a ‘direct hire employment’.
