What is security of tenure? Ang ‘security of tenure’ ay ang kasiguruhan, sa ilalim ng batas, na hindi basta-basta matatanggal sa trabaho o empleyo at isang manggagawa kundi’t mayroong karampatang kadahilanang ayon sa batas (just and legal cause) at matapos dumaan sa karampatang proseso (due process). Ibig sabihin nito’y kapag regular employee ang isang manggagawa, hindi siya basta-basta matatanggal kundi’t may legal na dahilan sa kanyang pagkaka-tanggal at matapos sumunod ng employer sa requirement ng notice at hearing.


Halimbawa, kung ang isang accounting clerk sa isang opisina at nakapag-serbisyo na ng at least six months, dahil sa ang kanyang trabaho bilang isang accounting clerk ay ‘necessary and desirable in the usual course of trade or business’ ng kanilang opisina, ang accounting clerk ay kinokonsidera na ng batas na isang regular employee. Kapag regular employee na siya, hindi siya maaaring tanggalin o i-dismiss sa kanyang trabaho kung walang just cause at kung ang employer niya ay hindi susunod sa due process (notice at hearing).


Paano naman ang mga OFW? Sila ay nagta-trabaho sa ilalim ng isang contract of employment, diba? Mako-konsidera ba silang regular employee? Do they enjoy security of tenure? Ang proteksiyon ba ng ‘security of tenure’ ay extended sa kanila kahit na sila ay under sa isang contract of employment at sila ay naninilbihan sa labas ng bansang Pilipinas?


Ang pagiging OFW ay isang gawain o hanapbuhay na pinoproteksiyunan ng ating mga batas. Una, para legal ang status ng isang OFW na mangingibang-bansa, required na ang kanyang employment contract ay POEA-approved. Ang approval ng POEA sa contract of employment ay nangangahulugan lamang na ang employer sa pamamagitan ng kanilang local agency sa Pilipinas ay pumapayag na magpa-ilalim o magpa-saklaw sa ating Labor Code. Kaya mahalaga na ang inyong contract ay POEA-approved.


Pangalawa, ang bawat OFW na may POEA-approved contract of employment ay protektado ng principle of security of tenure during the duration of his contract. Ibig sabihin nito, habang may bisa ang contract of employment, may security of tenure ang OFW. The law considers the OFW’s employment under the contract as ‘regular employment’ but with a limited duration. Ang ibig sabihin nito, habang ang OFW ay nasa ilalim ng POEA-approved employment contract, hindi siya basta-bastang matatanggal sa trabaho kundi’t may just cause at ang pagtatanggal sa kanya’y isinagawa ng sumusunod sa requirement ng due process.


Anu-ano ba ang mga just causes? Ang mga just causes ay ang mga dahilan na puedeng gamitin ng employer para legal na ma-dismiss ang kanyang empleyado. Ang mga just causes ay: serious misconduct, willful disobedience to lawful orders, gross and habitual neglect of duties, fraud or willful breach of trust, commission of a crime or offense and analogous causes. Kung ang pagtatanggal sa isang OFW ay hindi dahil sa anim na kadahilanang ito, ang pagtatanggal sa kaniya sa trabaho ay illegal. Ito ay illegal dismissal.


Halimbawa’y ang OFW na domestic helper ay tinanggal sa trabaho ng kanyang amo dahil sa siya’y pinagseselosan ng asawa ng kanyang employer, ang pagseselos ay hindi sapat na kadahilanan upang siya’y alisin sa kanyang posisyon bilang domestic helper. Ang pagseselos ay hindi isa sa mga just causes na enumerated sa Labor Code. Kung pina-uwi ang domestic helper sa Pilipinas sapagkat binawi na ng employer ang kanyang contrata, pag balik noong domestic helper sa Pilipinas, maaari niyang ihabla ang agency na nag-deploy sa kanya ng illegal dismissal.


Ang agency ang tatayo sa lugar noong foreign employer. Ang agency din ang tatayo at mananagot kung mapatunayan na ang pagkaka-tanggal sa trabaho o pagkaka-terminate ng employment contract niya ay hindi para sa isa sa mga just cause na nakalathala sa ating Labor Code.


Sa susunod, we will explain o ipapaliwanag ang mga just causes for termination. At sa iba pang mga article na susunod, sasagutin ang mga katanungang: anu-ano ang mga relief o danyos na maaaring makuha ng isang OFW na na-terminate ang employment contract nang walang just cause? Makaka-kuha ba siya nang sahod na katumbas ng unexpired portion ng kanyang employment contract? Abangan….



Topic: The employees’ right to security of tenure demands that they be removed only for any of the just or authorized causes defined under the Labor Code (called "substantive due process") and only after the employer observes procedural due process.


Even if there may have been a just or authorized cause for termination, an employee who is dismissed without procedural due process is entitled to nominal damages, the amount of which is subject to the discretion of the court. For this purpose, the court will take into consideration the relevant circumstances of each case, particularly the gravity of the employer’s failure to follow due process requirements. The nominal damages serve as a penalty on the employer for its failure to comply with the requirements of procedural due process for terminating employment.
