Breach of contract: Iba ang job description sa pinirmahan

Pwede po ba baguhin ng employer ung contrata? Sales agent po kasi ako. Sa pinirmihan ko po naka lagay po dun na meron kaming 3 araw na field work, 2 araw na home base and 1 araw na mag rereport sa office sa loob ng 1 week. Ang ngyayari po lage lang kami sa office nag tatawag lang. Nag coconduct din po kami ng meeting kahit sa restday namin at kung anong oras gustuhin ng boss. Legal po ba yun?

Ganito kasi iyon. Mayroong management prerogative ang mga boss. Kahit na kayo ay may pinirmahan na kontrata kung saan naka-saad ang inyong mga schedule of work (3 days in the field, etc) puedeng baguhin ito ng boss ninyo if the need of the business demands it. Kasi, kung pasko, halimbawa, sobrang lakas ng demand, kaya malamang sa sa halip na 3 days lang sa field, mapipilitan kayong mag 7 days sa field. That is allowed.

Kasi, sa totoo, when you are employed, your boss determines the manner by which you will perform your job. Kung mas makabubuti para sa business ninyo na kayo'y maglagi sa office sa halip na mag-field work, then the employer can make you stay in the office.

Puwera na lamang kung halimbawa, kapag kayo'y nag-field work, mas mataas ang inyong kikitain. Kung hindi kayo pahintulutan na mag field work katulad ng inyong pinagka-sunduan, kailangan pa rin na ibigay sa inyo iyong suweldo na dapat ibayad sa inyo kung kayo'y nag-field work kahit na kayo'y namalagi sa inyong office lamang. kasi, hindi dapat mag-suffer ng diminution of salary or wages ang isang employee.

Iyong sa rest day, ang batas kasi ay nagre-require na mabigyan ng isang araw na pahinga ang mga employees every seven days of work. So, ibig sabihin nito, hindi puedeng i-demand ng empleyado kung kailan siya magde-day off (puwera na lang kung halimbawa ikaw ay Jewish at ang Sabbath ninyo ay forbidden kayo to work because of religious reasons -- your employer must give you the Sabbath day as your day off).

The best thing to do is to consult a lawyer. Dalhin mo iyong contract of employment na pinirmahan ninyo. Kung meron kayong rules and regulations o employee's handbook, dalhin mo din.
