Hindi makaalis ng barko, kahit may Seaman's book at PDOS na

Nag apply po ako last year September sa isang agency para sa seabased, at natanggap naman ako. At agad pina medical trainings kuha ng seamans book at US visa.


At tapos nako nag PDOS pero til now almost 1 year nako nag hihintay wala pa din, depende sa vacancy pa daw ng barko.


Last week nagpunta ako sa agency ko para tanungin kung makakaalis bako ngaun taon na to at hindi pa daw alam kailan ako pwde makaalis. At tinanung ko kung kukunin ko mga docs ko dahil sa sobrang tagal. Kaylangan ko daw magbayad more or less ng 25k kahit hindi ko kasalanan Sabi ko oo daw, pero wala pa ko pinipirmahan contrata. Gusto ko na kasi kunin mga docs ko para maka pag apply na sa iba. Sana matulungan nyo ko ano kaylangan Kung gawin. Salamat po

Una po sa lahat, kung kayo'y walang pinirmahang employment contract, kayo po ay malaya. kasi, hindi naman po kayo dapat na tinanggap noong manning agency kung wala silang job contract na bukas at approved ng POEA.

Pangalawa, kasi po, may crisis po sa langis sa Middle East. Ito po ang dahilan kung bakit matumal ang pag-sampa sa mga barko ng mga seaman. Marami po kasing mga barko ang na-tenga sa port dahil sa wala nang langis na mai-deliver.

Pero, mukhang hindi naman kayo sa mga tanker nagpa-assign kundi sa isang cruise ship, so , hindi ko alam kung bakit hind pa kayo nakaka-sampa sa barko.

Karapatan ninyong makuha ang inyong mga documents kung kayo'y hindi kayang mai-deploy ng kumpanyang iyan. At kung hindi sila ang lumakad ng inyong mga papeles, at kung wala silang maipakitang mga pinagka-gastusan nila para sa inyo, well, wala kayong dapat na bayaran.

Ang pinaka-maigi po niyan, kayo'y lumapit sa isang abogado at ang abogado ay dapat na gumawa ng isang demand letter. Kung wala kayong pondo para kumuha ng isang pribadong abogado, maaari naman kayong lumapit sa Public Attorney's Office (PAO) or kaya sa Integrated Bar of the Philppines (IBP) mayroon po silang free legal assistance. Sila po ang susulat sa inyong deployment agency para hingin na ibalik ang inyong mga papeles sa inyo.
