Maari mo bang i-report na ‘lost’ ang passport mong ayaw ibalik sa iyo ng employer mo? (Can you report lost passport if your employer refuses to return our passport to you?)


May mga OFW na ang passport ay required na i-surrender sa kanilang employer habang sila ay nagta-trabaho. Minsan, may mga OFW na hindi masaya sa kanilang employer at nais na nilang lumipat ng employer o di kaya’y umuwi na lamang sa Pilipinas. Ang problema nga lang ay ayaw ibalik sa kanila ng kanilang employera ang kanilang passport.


May mga ibang OFW na ang ginagawa ay iniri-report na lamang na ‘lost’ ang kanilang lumang passport na nasa employer nila at nag-a-apply ng bagong passport sa Philippine Embassy. Ito ba ang dapat mong gawin?


Kung tutuusin, ang isang passport na ayaw nang ibalik sa iyo ay dapat lamang na ikonsiderang ‘lost’ kasi, hindi mo na ito makuha dahil sa ito ay withheld from you and against your consent. Pero kung direkta mong idedeklarang ‘lost’ ang passport mo, mahihirapan kang kumuha ng bagong passport dahil sa kailangan mo ng police report at affidavit of loss na nagbibigay ng mga detalye kung paano mo nawala ang iyong lumang passport. Please note that a police report and an affidavit of loss are two documents required by the Philippine Consulates before they can process your application for a lost passport.


Isa pa, kailangan mong magpri-senta ng isang original official NSO copy ng iyong birth certificate at iba pang mga identification (SSS, TIN o anumang government-issued ID) sa iyong pag-a-apply ng bagong passport sa Philippine Embassy. Kailanga mo ring ma-prove ang iyong Philippine citizenship. You can prove this by the government-issued IDs you may possess. Kung wala ang mga ito, hindi ka makaka-kuha ng bagong passport.


Ang mas maiging gawin ay mag-report sa police o sa Philippine Embassy or Consulate (Office of the Labor Attache) na ikaw ay isang OFW at ang iyong passport ay withheld ng iyong employer. Ang Office of the Labor Attache ang puedeng mag-negotiate na ibalik ang iyong passport sa iyo ng iyong employer. Please note that the labor attaché and the Philippine Embassies abroad are tasked to render assistance to nationals in distress. Kapag ayaw ibalik ng employer mo ang iyong passport, you are considered a Philippine national ‘in distress’. The Philippine Embassy can then help you by rendering legal advice, consular assistance, and processing of legal documents such as passports and visas.


Kung ayaw talagang ibalik sa iyo ang iyong passport, dahil sa may official report ka na sa police or sa Embassy, maari mo nang ilagay ang mga bagay na ito sa isang affidavit of loss na kailangan mo bilang supporting document.


May interview din sa consul ang lahat ng nag-a-apply ng bagong passport. The consulate will exert efforts to verify your records from the DFA and the NSO. The consul will try to determine kung totoo nga ba ang mga kadahilanan mo kung bakit nawala ang iyong passport. Kung mag-i-imbento ka lang nga kuwento kung paano mo ito nawala, baka hindi ka paniwalaan ng consul. Lalo kang mahihirapan. Mas mabuti pang sabihin mo na lang ang totoo na withheld ng employer mo ang iyong passport kung kaya’t ikaw ay humihingi ng tulong na makuha ulit ito at kung hindi na mababawi pang muli ay isyuhan ka na lamang nga bagong passport.


Magkakaroon ka ng problema kung halimbawa’y ang iyong passport na luma ay fake o di kaya’y ang pangalan sa passport ay iba sa iyong tunay na pangalan. This means that your old passport is a fraudulent passport. Magkakaroon din ng problema kung iba ang iyong civil status mula sa mga dokumento sa NSO doon sa naka-saad sa iyong lumang passport dahil sa hindi magtu-tugma ang mga records mo sa DFA.


Kailangang ang lahat ng iyong personal information ay mako-confirm mula sa mga website ng NSO at DFA. Bawa’t request for confirmation ay may bayad kasi, magse-search pa ang NSO at DFA sa kanilang indices or archives.


Your Philippine passport is your primary means of identification. Any person (recruiter man or employer) na mag-attempt na kuhanin sa iyo ang iyong passport ay walang magandang layunin. Kapag wala kang passport, hindi ka puedeng lumabas sa mga kalsada sapagkat baka ikaw ay hulihin bilang isang illegal alien at i-deport sapagkat hindi mo ma-prove ang iyong identity. When an employer asks you to hand your passport over, don’t hand it over. Leave that employer and go to the nearest embassy for your own protection. Huwag ipag-sapalaran ang iyong safety para lamang makapag-trabaho ka. Mahirap na kung ikaw ay maging bihag ng iyong employer sapagkat siya ang mag tangan ng kaisa-isang patunay ng iyong pagka-tao at nasyonalidad.

The Embassy is the principal representative of the Philippine Government in the conduct of its relations with the Government of the United States of America. In this capacity, the Embassy promotes the foreign policy thrusts of the Philippines. The Consulate replaces lost Philippine passports. The Consulate will verify the details of the lost passport, which will take at least 15 days. Only after the said verification will the Consulate begin the process of the replacement of passport. The Consulate will require certain documents for the administrative procedures. Applicants who are not permanent residents may be required additional documents to validate details.

Hi, Chona. Naku, yung tanong mo ay bahagi ng 'nagbabagang' mga balita sa Pilipinas ngayon. May mga kababayan kasi tayong mga OFW sa Riyadh na ang problema ay inipit ng employer nila ang kanilang mga passport kung kaya't humingi sila ng tulong sa mga opisyal ng embahada doon.

Sa kasamaang palad nga laang, ang iba sa kanila ay pinag-samantalahan diumano ng mga opisyal ng embahada sa Riyadh. Ang tawag sa mga iskandalong ito ay 'sex for flight' kasi, ibinubugaw daw ng mga opisyal sa embahada ang mga OFW na walang pasaporte at walang pera para umuwi sa Pilipinas. Lahat yata ng empleyado sa embahada sa Riyadh ay pinauwi na ng DFA at nang DoLE dahil sa iskandalong ito.

Kasi, talagang embahada lamang ang masusulingan ng mga OFW na nawalan ng mga papeles dahil sa inipit ng employer o dahil sa sila'y inapi o minaltrato ng mga employer nila. Yung mga TNT na walang karampatang mga work visa sa Saudi ay naka-tira sa tent sa may embahada habang nag-hihintay na ma-proseso ang kanilang mga papeles (bagong pasaporte). Ang iba sa kanila'y nakarating nga Saudi nang ang mga pasaporte ay iba sa kanilang tunay na katauhan (iba'ng pangalan, etc.) kaya't natatagalan. Ang ticket nila ay sinasagot ng mga ilang NGO or kaya't ng Office of the Vice President o kaya'y ang office ni Senator Manny Villar. The best option is to still ask assistance from our embassy. They are the only ones who can help an OFW stranded without a passport abroad. It is their job.

hi atty.ako po si Diana, may tanong po ako.. nasa isang agency kasi ang passport ko.. nag apply ako noong 2013 after ng bagyong Yolanda kasi po parang yon lang po yong pag asa ko non, however I got scared and decided to back out after a week or so. Pero ayaw nila ibalik ang passport ko.. pinababayad po ako ng 2k para makuha ko yon, di kopo nakuha kasi wala po akong pera nun hanggang sa makawork ako dito sa cebu. Di na po ako nakauwi at kailangan ko po ang passport ko ngaun. Nag apply ako ng bagong passport thinking na expired na yon at it will not matter which I realized a very stupid thing I have done ever. Ngayon nasuspende yong application ko tapos sinabi nawala sa nagyo ang passport ko. As expected pinakukuha ako ng affidavit of explaination pati police report and affidavit of los. Pero I did some research and found out na bawal yong ginawa ng agency. I am currently trying to get in touch with the agency para makuha ang passport ko. Ano po ba nagmas mabuting gawin? Gusto ko talaga makuha ko nalang ang passport ko. Pwede ko bang sabihin sa agency na irereklamo ko sila kung ayaw nilang ibigay ng libre ang passport ko? tulungan niyo po ako please..
