Claim rights for enrollment system done for school - May habol ba ang aswa ko sa enrollment system na gawa nya sa school?

May habol pa ba ang asawa ko sa enrolment system na gawa niya sa school? Teacher sya dun at yung system e di linya ng trabaho nya. Ginamit kasi nila yun ng libre for almost 4 yrs.. Last year ginawan ang asawa ko ng issue ng magrequest sya sa dean ng bayad para sa system na matagal na nilang ginagamit..kahit daw royalty fee bang tawag dun...sabi ng dean sige gawa sya letter, gumawa sya ng letter na nagtatanong kung pwede nga makakuha ng bayad or kahit royalty fee lng. Then ng ipasa ng dean s main branch iba ang kwento nya..Nagdedemand daw ang asawa ko ng bayad. After nung pangyayaring un ginawan nila ng paraan para di na mkapagrenew ng contract sa kanila ang asawa ko at pinabantayan pa nila sa guard ang room kung saan nakainstall ang enrollment system.

The school used this system for free for almost 4 years. Last year, my husband requested for some payment for the system that they have been using, even just a royalty fee. The dean told him to write a letter. When it was passed to the dean of the main branch, they changed the story, and they are saying that my husband is demanding payment. After that incident, they did not renew my husband's contract and they had a guard watch the room where the enrollment system is installed.

Teka, let's see kung naiintindihan ko. Ang teacher mo ay teacher sa isang paaralan (ng computer ba)? Siya ay gumawa at gumamit ng isang software na siya rin ang may-akda. Ito ay ginamit ng eskuwelahan na libre. Tapos, humingi ang asawa mo ng bayad para doon sa software na kanyang ginawa, hindi na ni-renew ang kanyang teaching contract? Ganoon?

Mahirap sa akin dahil sa wala akong nakikitang papeles (hindi ko nakita ang contract of employment ng asawa mo). Hindi ko alam kung ito ba ay year-to-year. Hindi ko nakita kung ang kanyang kontract at isa lamang contract of adherence at siya'y talaga naman regular employee ngunit, ayaw lamang na ma-regularize kaya binibigyan ng yearly contract. Hindi ko rin alam kung ang asawa mo ay ilang taon na in total na nagta-trabaho doon. Hindi ko alam kung siya'y na-promote na from one position to another. Hindi ko alam ang kanyang duties. So, hindi ko masasagot kung illegal ba ang hindi pagpre-renew ng kanyang contract.

pero ito ang masasabi ko -- wala namang bayad ang mag-habla sa NLRC ng illegal dismissal. Humanap kayo ng abogado na talagang labor ang specialization. May mga dating PAO lawyers na nag-retire na na magaling sa Labor law dahil sa talagang familiar na sila sa rules ng Labor Law.

Patungkol naman sa software, depende iyon sa kung ang asawa mo ba ay may confidentiality agreement. Depende din yon sa kung ang contrata niya ay nagbibigay sa kanyang employer ng ownership rights or copyrights sa kanyang mga ginagawa bilang teacher. at hindi ko rin alam kung ang software na ginawa niya ay ginawa niya bilang teacher (kasama ba ito sa kanyang regular duties).

Ang pinaka-maigi ay dumulog o komunsulta sa isang Patents Lawyer. Kailangan kasi, maipa-rehistro ng asawa mo ang kanyang invention na software. kailangang ito'y nasa kanyang pangalan. Bago niya ma-claim na ginagamit ito ng school na walang bayad.

Ang suma tutal, kailangang komonsulta sa mga abogado: para sa labor at sa copyright/patent.
