Positive pregnancy test, pay agency damages

Good day po. Hindi po ako nakaalis ng bansa dahil ng positive po ako sa pregnancy test. Flight ko sana ng Nov.19, 2013 and Nov 18 ang preg test. Nakunan po kasi ako ng september. Hindi ko po expect na mag positive parin ako. Nakapagbayad po ako ng 5k para sa processing. And additional 7,600 bago ako magflight.. tapos 22,500 daw po placement pero nagdown po ako ng 15k.. hindi na po binalik sakin laht ng pera dahil kasalanan ko daw nangyari. Dahil hindi ko daw sila ininform na nakunan ako. So ako ang pinagbabayad nila sa plane ticket and visa.. plus damages sa employer. All in all 30,690 lahat.. may kulang pa daw ako 8,090 skanila.. kaya nasa kanila pa passport ko..pinagawan po ako ng letter na parang nakasaad dun na nangangako ako na bayaran ung 8k na kulang ko and na ako ang may kasalanan na di ako nakaalis dahil nag positive nga po ako.. and nalaman ko na kahit bayaran ko ung kulang hindi narin nila ako mapapaalis dahil kinancel na ako ng employer. Hindi po alam ng magulang ko ung nangyari.. ang snbi ko po kung bakit di ako nakaalis ay dahil may problema sa papers ko.. and ngayon kinukulit nila ako na bawiin ung pera na nabigay ko sa agency.. Baka daw fake ung agency.. ano po kaya gagawin ko?? Please help po.. salamat po ng marami. need ko po tlaga ng tulong.. first timer po kasi sana ako for abroad.



Translation: I was supposed to leave to work abroad on November 19, 2013. But I had positive pregnancy test last November 18. I had a miscarriage last September, so I did not expect to get pregnant again so soon. I paid 5 thousand for processing, and additional 7,600 before flight. Then they told me that I also needed to pay 22,500 as placement fee, so I had made down payment of 15,000. They did not return the money to me, because they said that this is all my fault, and that I did not inform them that I had a miscarriage last September. So they charged me plane ticket, visa, damages to the employer, which costs 30,690 all in all. They told me that I still owe them 8,090. So they have not returned to me my passport. They also asked me to write a letter promising that I would pay the 8 thousand pesos balance. My parents do not know about this, so they are nagging me about the money that I've paid the agency, and they are worrying that the agency may be fake and a scam. What should I do?

Naku, you have a really big problem. I think na ang relationship mo sa mga magulang mo ang pinaka-mahalagang pag-tuunan mo ng pansin. Tell them the truth sa nangyari sa iyo. Tapos, kumunsulta ka sa isang abogado na ang practice ay specilised sa POEA. Malamang sa kailangan mong mag-habla. Hindi ko kasi nakita kung ano iyong pinirmahan mo at hindi ko alam kung ano ang kontrata ninyo.
Sa totoo, kung nakunan ka, dapat hindi na positive ang pregnancy test. Na-raspa ka ba? Kasi kung hindi ka na-raspa, malamang sa iyon ang dahilang kung bakit positive ang pregnancy test mo. Sa ganoong situwasyon, hindi kasalanan ng agency iyon. Malamang sa yung processing fee hindi mo na mabawi. Yung placement fee at iyong ticket, dapat makuha mo pa iyon. Kailangan mong kumausap ng abogado at kailangan mong ibigay sa kanya lahat-lahat ng detalye pati na ang mga kopya ng kung anumang mga papeles ang iyong pinirmahan sa agency. Hindi kita masagot ng payak dahil sa wala akong basehan kundi iyon lamang mga sinabi mo sa akin. Kung anuman iyong pinirmahan mo sa agency, iyon kasi ang masusunod dahil sa contract iyon. You need a lawyer.Hindi puwedeng basta sa internet ka lang kokonsulta. Kailangan kasi ng abogado ng mga detalye para mabigyan ka ng opinyon.

Yun po kc sa ticket ko promo ticket po daw kc yun.. kaya non refundable kaya sakin po ipinabayad.. and un nga po may kulang pa daw akong 8k para makuha ko passport ko... tapos po damages pinabayad din po sakin.. hindi pa naman po ako pumirma ng contract sa employer.. dun plang po sa agency.. sila po ang gumawa ng letter about sa ako nga daw po ang may kasalanan and nka break down po doon ung mga expenses like visa, plane ticket and damages to the company. computerized po kc un and then pinakopya po sakin hand written.. and then signature ko and thumbmark.. hindi po kasi ako naraspa kaya po sguro nag positive ako.. the problem po now is hindi po ako na gawan ng receipt.. sa mga bnyaran ko.. maraming salamat po atty. .. at least po ngayon nalinawan na po ako.. kokontakin ko po agency ko for the receipt.. and ung copy ng letter na pinapirma sakin.. pag nakakuha po sguro ako saka po ako papatulong sa poea po..
