Deed of sales - Can tenant sell his agricultural land?

Atty may nabili po kasi kami agricultural land. 2 hectares po un. Ang nabili palang po namin eh ung kalahati ng 2 hectares. Yung 1 hectare po natira pa kasi sa tenant daw po yun. Ngayun po gusto na din po ibenta ng tenant s amin ung 1 hectare na natira. Yung tenant nalng po ba ang kailangan pumirma sa deed of sale? Kasi diba po ang pag tenant ka automatiic sa iyo na ang kalahati ng lupa? O kailangan pa po pumirma ung nakapangalan sa title? Pano po kung patay na yung nakapangalan sa title? Salamat po.



Topic: I bought a piece of agricultural land, around 2 hectares. But we've only bought 1 hectare, and the other hectare is still with the tenant, because the tenant is still staying there. Now the tenant would also like to sell the 1 hectare that he has. Can we just talk and negotiate with the tenant? Can the tenant just sign the deed of sale? Or does the owner/ person which the land title is named after still sign? What if the person whose name the land title is under, is already dead?

Naku, napaka specific ng tanong mo. Hindi ko ito masasagot dahil sa wala akong nakitang mga dokumento. Hindi ko alam kung bakit ang tenant ang magbebenta ng lupa gayong tenant lamang siya (umuupa sa may-ari-- ito ang ibig sabihin ng tenant).

Maaring ang tenant ay beneficiary na ng land reform kaya't napasa-kanya na ang lupa. Kung ganoon kasi, mahigpit din ang batas, ipinagbabawal na ibenta ng tenant awardeeang mga lupaing nakuha sa ilalim ng land reform.

You really need to see and consult with a lawyer na ang specialty ay agricultural law. And you need to bring your documents --para ma evaluate niya. I cannot helpo you as I do not specialize in agricultural law practice and hindi koi nakita ang mga papeles.

So please see a lawyer para naman protektado ang mga karapatan ninyo.
