Lupang walang titulo at nawawalang deed of sale-lost and no title

May lupa po ako sa Zambales na walang titulo at nawawala na rin po ang deed of sale..paano ko po kaya ito mapapagawan ng titulo kung wala naman akong dead of sale..ibenenta lang po samen ang lupa tapos isinanla naman ng nanay ko sa bangko..sa hndi inaasahang pangyayari, nagsara na po ang bangko na pinagsanlaan ng lupa..tumawag po ako sa PDIC para tanungin kung nasa kanila ba ung dead of sale ng lupa kasi yun daw ang ginawang collateral ng nanay ko para makahiram ng pera sa bangko pero ang sabi sa akin ng PDIC, wala daw silang hawak na deed of sale ng lupa namin pero naka register sa kanila na may loan ang nanay ko sa bangko na nagsara na..



Topic: I have a land in Zambales that does not have a title and the deed of sale was lost. How can I get a title if I do not have the deed of sale? The land was sold to us and my mother pawned it to the bank. Unfortunately, the bank closed down. I called PDIC (Philippine Deposit Insurance Corporation) to ask if they have the deed of sale because the land was used as the collateral for the loan. But PDIC said that they do not have the deed of sale, but there is record that my mother made a loan in the bank.

Una sa lahat, hirap akong makapaniwala na may mga lupa pa hanggang ngayon na hindi pa rin nasasakop sa ilalim ng Torrens system. paano'ng walang tituto ang lupang ito? Kasi, baka may mother title ito at hindi pa lamang naihihiwalay at naibubukod mula sa mother title ang lupa ninyo (kaya mo nasasabing ito'y walang tituto).

O kaya, baka naman kaya walang titulo ang lupa, dahil sa ito'y forest land o timber land, o kaya'y ancestral lands ng mga katutubo. Ang mga ito'y hindi alienable (hindi puedeng ibenta pagkat pagmamay-ari sila ng bansang Pilipinas). Kung kaya't hindi pa ito nasasakop ng Sistemang Torrens.

Ang deed of sale ay maaaring maging prueba na ang lupa at natamo sa ilalim ng isang fee simple (kaparaanang ligal). Ang isang deed of sale ay dapat naka-rehistro sa isang notaryo publiko (yung abogadong nag-notaryo noong Deed of Sale ay dapat na mag-tabi ng kopya). Dapat din ay may itinabing kopya sa Sheriff's office ng Province of Zambales kasi doon inilalagak ang lahat ng kopya ng Deed of Sale na ninotaryo.

BUhay pa ba ang mga tumatayong may-ari ng lupa? Bakit hindi na lamang sila mag-execute ng panibagong Deed of Sale o di kaya't isang paglilinaw (o memorandum). Ito ang ipapa-notaryo para may prueba ng ownership.

Kailangan ninyo ng payo ng isang espesyalista sa Land Titles and Deeds. At kailangan din ninyong maging resourceful na mag-hanap ng ebidensiya para ang pagmmay-ari ninyo ng lupa ay inyong mai-prove at nanang kayo'y ma-isyuhan ng bagong titulo ng tupang iyan.

Parehas po kami ng kaso.nakabili po ng lupa ang tatay ko way back in the 80's..partition po ito nung mother land..bale hinati po sa apat ung lupa at isa ung tatay ko sa mga nakabili..Ang problema po eh nawawala ung deed of sale..pwede po ba kami magpagawa ng bagong deed of sale? pwede po ba nmin hiramin ung deed of sale nung ibang nakabili ng lupa para mapatunayan na isa ung tatay ko sa nakabili nung portion nung lupa? Sa Sheriff din po ba ng lugar nmin kami pwede magpagawa ng bagong deed of sale? Ang alam ko po kasi patay na ung principal owner nung lupa..saan ko po pwede makitang ung duplicate copy nung main title ng lupa?
