Problema sa mga kapatid tungkol sa lupa, land confiscation, sinisingil ng pera

May karapatan ba ang aking mga kapatid na kunin sa akin ang lupain na nasa aking pangalan? Dati na nila akong kinasuhan ngunit nagdesisyon ang korte na sa akin ibigay ang lupain. Nagbentahan sila ng parte ng lupa ko ng wala akong alam. At ngayon ako pa ang sinisingil nila at sabi maghahabla sila. Ano ang dapat kong gawin?


Translation: Does a sibling have the right to confiscate a land under my name? They filed a case against me in the past, but the court ruled in favor of me and gave the piece of land to me. My siblings sold parts of the land without my knowledge. Now they want to charge me money for the land and threatened to sue me (litigation/lawsuit). What should I do?

You should find yourself a good criminal law lawyer who is also experienced in filing cases involving real estate. What your siblings did (selling the lot without your knowledge or consent) is fraud. It is a criminal case as well as a cause for filing a damage claim.

If the lot is in your name, the sale made by your siblings can be voided. They cannot sell a lot or even a portion of a lot that is not registered in their name. As for the persons who bought the lot from your siblings, if he decides to enter and build a structure on the lot, you can actually file a case for ejectment.

You need a lawyer to do all this. This is a complicated legal matter. Please get yourself a good lawyer.
