Atty.nakatira po ang pamilya namin sa property po na minana ng aming ama at ng tatlo pa po niyang kapatid sa kanilang magulang. Namatay na po yung isa nilang kapatid at ang tatay namin. Ngayon po kami po ay pinapalayas ng tiyahin namin(kapatid po ng tatay namin) dahil wala daw po kaming karapatan sa property.

Ang titulo po ay nakapangalan po sa kanilang magulang at ito pong property na ito ay nagkakaso po, inilaban po ito ng tiyahin namin sa pangalawang pamilya ng kanilang ama. Kaya daw po wala kaming karapatan at ang tatay namin. At yung titulo po ng property na ito ay napunta po sa ibang tao sa kakilala daw po niya dahil ipapaayos daw po ng tiyahin namin ang pangalan pero wala po siyang binanggit kong kanino at anung pangalan, at tumanggap po ang tiyahin namin ng pera mula po dun sa taong pinagbigyan po niya ng titulo.,at sinabi po niya na nawawala daw po ang titulo kaya pina- stolen po niya ito sa BIR. Tanong ko lang po Atty. anu po ang dapat namin gawin ng pamilya ko. Ako po sana ay inyong matulungan. salamat po.



Topic: My familly lives in a property that was inherited by our father and his 3 siblings from their parents. One of the siblings and our father passed away already. Now our aunt (my dad's sibling) is forcing us out of the property because according to her, we have no right to it.

The property is under the name of my grandparents, but there was a lawsuit case and my aunt fought for it from the second family of my dad. That's why we do not have the right to the property, according to her. She also said that the property has been transferred to another person, an acquaintance, because she had the name fixed, but she did not mention who this person is. But she received money for it. Afterwards, she said that the land title is lost and so she reported this to the BIR as stolen. What should we do?

Una sa lahat, you need to hire a lawyer because, you will need to start a legal battle on two fronts: you will have to file a civil case pati na ang isang criminal case.

Criminal case dahil sa baka may fraud na naganap. Kung ang lupa, as you said, was registered sa pangalang ng grandparents ninyo, dapat ay nalipat ito sa kanilang heirs (ang tiyahin mo, ang tatay mo at ang uncle ninyo na namatay na rin). Kung ililipat ito, dahil sa ito'y naibenta na, dapat muna ay mailipat sa dahil sa patay na ang tito mo at ang tatay mo, dapat ay ang mga anak at asawa ng tito mo at nang tatay mo ang substituted heirs.

Kung totoo na ang tiyahin mo ang gumastos upang ang lupa ay maipalipat sa kanila dahil sa ito nga ay inaagaw ng pangalawang pamilya ng grandfather ninyo, hindi pa rin ibig sabihin na wala na kayong karapatang mag-mana -- babakas lang kayo at susuklian ninyo iyong mga nagastos niya.

Dapat ay labanan ninyo sa Register of Deeds (dapat na hindi maglabas ng bagong titulo kung hindi ma-klaro ang pagsasalin). Kung ini-report na ang owner's duplicate ng titulo ay "lost" hindi pa rin ito puedeng isyuhan ng bago sa ibang pangalan. Sa pangalan pa rin ng grandparents ninyo.

You have to settle your grandfather's estate and settle your father's estate para ma-klaro ang partihan at manahan.

I also think that you should seriously consider if may ginawang fraud ang tiyahin ninyo dahil sa hindi maipapalipat ang titulo sa pangalan ng iba nang wala siyang ginagawang mga papeles. So, a criminal case for fraud or for falsification of documents may be filed against her.

I would imagine that there will be a case for ejection filed against you. Dapat ninyong labanan ito. Pero, sadly, mas madaling mag-file ng ejectment case kaysa sa case to question a fraudulent transfer of ownership ng isang parcel of land. So, you should really seek the advice of a lawyer.

Huwag kayong aalis sa lupa kung walang court order na nagpapa-alis sa inyo. Yun nga lang, baka naman dangerous para sa inyo.
