Kung gusto ng ibenta ng tenant ang kanyang parte sa agricultural land ano ang mga kailangan upang maibenta nya ito?

Teka, hindi ko ito maintindihan. Kasi, pag sinabing "tenant" ang isang tao, siya'y umuupa lamang sa isang landlord o panginoong may lupa. Hindi sa kanya ang lupain, nagbubuwis lamang siya sa may-ari upang magkaroon ng karapatang mag-saka sa lupa. He doesn't own the land. He cannot sell what he does not own, diba? Kung hindi sa akin ang lupa, hindi ko maaaring ibenta ito.

Kung ang lupa naman ay naa ilalim na ng Land Reform kung kaya't ang dating tenant farmer ay naging land owner na dahil sa land reform, ibang usapin ito. Una, may restrictions ang land reform. May ilang taon na hindi puedeng ibenta ng tenant farmer ang lupang in-awardsa kanya sa ilalim ng land reform. Kung tapos na iyong holding period, iyon, maaari na niyang ibenta. Pero kasi, kung ibebenta ng tenant iyong lupang in-award sa kanya, it defeats the social justice purposes of land reform.

Ngayon, baka ang sinasabi mo'y ang gusto noong tenant ay ang ibenta sa iba ang kanyang right of tenancy. Kumbaga, iyong karapatan niyang magsaka pati na ang obligasyong mag-buwis sa panginoong may lupa ay kanyang ibebenta. Hindi rin ito pinapayagan ng batas. Kasi ay kabauhayan ng mahihirap na magsasaka ang maaapektuhan nito. Ang agricultural tenancy kasi ay protektado ng mga batas. Hindi ako gaanong familiar sa mga batas na ito. Kailangang magtanong ka sa abogadong ito ang specilization. That's not me. Ang mga abogado ngayon ay para na ring mga doctor--may field of specialization kasi, napakaraming mga batas na ngayon.
