Can my Chinese husband in Malaysia get married to someone else? We are married

May asawa po akong chinese dito sa malaysia kasal po kami sa pinas at kasal din po kami dito sa malaysia... May iba na po sya pero hindi pa kami divorce.. Pwede ba silang ikasal sa ibang bansa kahit kasal pa kami? Dalawa po ang hawak kong married certificate isa sa pinas at isa dito sa malaysia



Topic: My husband is Chinese here in Malaysia. We were married in the Philippines and we also got married here in Malaysia. He has another woman now, but we have not divorced yet. Can they get married even if we are still married? I have 2 marriage certificates, one in the Philippines and the other here in Malaysia.

Naku, hindi ko masasagot kung ano ang magiging problema mo sa ilalim ng batas ng Malaysia dahil sa hindi naman ako abogada sa Malaysia. Sa ilalim ng batas ng Pilipinas, walang diborsiyo. So, kung ang isang taong kasal sa Pilipnas ay magpakasal din ng pangalawang beses sa iba dito sa Pilipinas, iyon ay bigamiya. Ang problema, kung kasal ang Malaysian dito sa Pilipinas pero wala naman siya sa Pilipinas at ang kanyang pangalawang kasal ay hindi naman dito sa Pilipinas, hindi naman makaka-abot ang kamay ng batas ng Pilipinas sa Malaysia o sa iba pang bahagi ng mundo.

So, common sense lang, kung nasa Malaysia kayo, ikaw ay kasal at hindi pa diborsiyado mula sa Malaysian mong asawa, at siya ay may iba nang kinakasama -- wala bang adultery o bigamy o concubinage sa Malaysia? Malamang ay sa ilalim ng Malaysian law mo siya puedeng kasuhan. Hindi sa ilalim ng batas ng Pilipinas -- kasi nga, hindi naman siya Pilipino at hindi naman siya naninirahan sa Pilipinas. So, hindi siya saklaw ng batas ng Pilipinas.

Ang mas masalimuot na tanong ay kung halimbawa'y ma-divorce ka na sa Malaysia, angg kasal mo sa Pilipinas ay hindi automatic na mapapa-walang-bisa din. Kahit na ipa-validate mo -pa at ipa-rehistro ang divorce ninyo ng asawa mo sa Malaysia, hindi pa rin ibig sabihin ay mai-invalidate na ang kasal mo dito sa Pilipinas!

Sa mga Pilipina diyan -- puede ba, huwag na kayong magpa-kasal sa Pilipinas? Kasi, dito'y walang diborsiyo! Mahirap ang annulment dito. So, kung foreigner din lang ang inyong mapapang-asawa, sa ibang bansa na kayo magpa-kasal. Huwag na kayong magpa-kasal sa Pilipinas. kasi nga, kahit na ma-divorce kayo sa ibang bansa, sa Pilipinas, kasal ka pa rin doon sa dati mong asawa --- no escape sa Pilipinas.

Third World na hipokrito ang mga batas natin dito. Kunwari'y ayaw na mabuwag ang mga kasal kahit na impiyerno naman ang mga pagsasama! So, kung may pagkakataon kayong ikasal sa ibang bansa, sa ilalim na lamang nga batas ng ibang bansa kayo magpa-saklaw para may divorce. Para sa mga tao ngayon, ang divorce ay isang fire exit -- labasan kung may panganib. So, unless sigurado kayong till death us do part na talaga ang pagsasama ninyo at sigurado kayong hindi ninyo kailanman hahangarin na humiwalay sa inyong asawa, huwag sa Pilipinas magpa-kasal. Walang divorce dito -- no exit. No escape.
