May binebenta po kasi saaking lupa na ang nagmamay ari ay namatay na po, ngunit hindi pa po ito naililipat sa panagalan ng magkakapatid na tigapag mana, maari ko po ba itong bilhin? nagkasundo po ang magkakapatid na ibenta nalang at mageexecute nalang ng extrajuducial settlement. ano po ang magiging proseso nito ? at mga requirements para mabili ko ang nasabing lupa? maraming salamat po.

Maari po ninyo itong bilhin provided mag execute po ng extra-judicial settlement of estate with deed of sale at pipirma po ang lahat ng mga heirs. Kailangan po na bayaran nila ng estate tax nito sa BIR, pati na capital gains, docs stamps and transfer fee sa Local assessor po. Kailangan po lawyer ang gagawa ng extra-judicial settlement with deed of sale at ipanotarized ito. Ang nasabing dokumento ay siya magbibigay sa inyo ng authority para mailipat po ang titulo ng nasabing property sa pangalan po ninyo.

Pwede po yan mailagay sa Deed of sale kung sino ang magbabayad ng lahat ng expenses para sa pagpaprocess for the transfer po ng title ng property na nabili ninyo. Ito po ay nakadepende sa agreement po ninyo. Usual practice po nami 10% of the value i retain muna pagnakuha na ang titulo saka na ang full payment. In this case, gagawa kayo ng separate agreement nito aside from Deed of Absolute sale.

Mas safe yung partial or retention of 10% of the remaining value pero ito po ay nkadepende sa agreement ninyo lalo na if kilala mo talaga yung seller ok lang din ang full payment agad after deed of absolute sale na ang iniexecute nila.

pwede po ba akong magpagawa ng special power of attorney para isang tao nalang ang representative ng nagbebeta? at saaaken naman po sa part ko pwede din po na since magaabroad ako na mjo matagal ang process ng pagpapalipat and transactions sa pagbili ng lupa once na done na yung dead of sale mag pagawa din ako ng special power of attorney para i authorize ang kaibigan ko para mailipiat sa pangalan ko ang lupang nabili ko? then attorney kasi yung binebentang lupa saken naka gitna siya sa ibang property na ibang may ari ang binibigay lang nilang daan before ay pang tao lang, then yung sasakyan napakiusapan naman na pwede na dumaan at willing silang pumirma ng kasunduan na pinapayagan nilang dumaan ang mga sasakyan na dadaan po dahil gagawin ko po sanang mini resort yung property, pwede po po kaya pagawan ng special power of attorney ang kasunduan namen ng may ari ng daan? salamat attorney

Pwede sila gumawa ng SPA na iisa nalang ang mag sasign for the deed of sale in behalf of all the heirs. In your part you can designate Attorney-in-fact to sign and process for the transfer of title. However, if you are in abroad dapat ang notarization ay sa consul kung saan bansa ka nagtatrabaho or nakatira. Hindi pwedeng ipadala ang documents dito kasi walang jurisdiction ang notary public sa iyo dahil nasa ibang bansa kana. After na notarized there ang SPA mo ipadala dito dapat nakared ribbon ito diyan.
