Mababawi pa po ba namin Ang lupa na isinanla ng Lola ko taong 1985?

May lupa po Ang Lolo ko na nasa 800sqm. at sa kanya po nakatitulo. Namatay po Ang Lolo ko at Sinanla po ni Lola yung 100sqm. sa halagang P2000 at may kasulatan na babayaran sa loob ng 5 taon, pag Hindi nabayaran sa kanila na Ang lupa, namatay po yung Lola ko, Hindi alam ng mama ko na nkasanla Ang lupa Kaya umabot ng 3 dekada, nalaman lang nila taong 2019 Kasi ipapasubdivide na Sana Ang lupa, pinapatubos naman ng sinanglaan ng P100,000. Kaya lang nagulat sila Kasi Ang laki ng pagpapatubos. Binahayan po nila yun ng 3 dacades na Rin pero bulok na din po yung bahay Kasi kahoy lang din, at ngayon po pinapaupahan nila yung bahay. Ngayon po nagdecide kami na bayaran na Lang ng 100k para matapos na po usapan, nagbago na po isip ng anak ng sinanglaan, ayaw na po ipatubos dahil ayaw na daw nila bitawan yung lupa Kasi matagal na daw po yun at 5 years lang Ang usapan... Kasama pa po yun sa binabayaran naming tax. Tama po ba na Hindi dumaan sa foreclosure yung property?

Walang basihan po ayon sa ating batas ang automatic na transfer of ownership of the property being used as a collateral kapag hindi nakapagbayad ng principal na obligation ang may utang po. Ito ay tinatawag na Pactum Commissorium. A foreclosure proceeding should be done po. So pwede talaga ninyong makuha ito provided you need to pay the principal obligation. Mas mabuting makipag usap sa creditor at humingi po ng consideration. If ever ayaw talagang ibigay mas mabuting maghire nalang po kayo ng lawyer to assist you in whatever legal action po na gagawin niya.
