Mapawalang bisa po ba ang adverse claim kung namatay na ang nagfile nito?

Gusto ko po sanang magpatulong sa inyo kung ano po ba dapat gawin.Ito po kasing kapit bahay namin umaga, tanghali at gabi palagi po siyang nag iingay sobrang ingay talaga.Sinasabihan niya po kami na magnanakaw ng lupa, at kung ano pang masasakit na salita.Sa sketch plan po kasi namin  may 42 square meter na nabuwag, at kini claim po ng kapitbahay namin na sa kanila daw po yon.Ngayon dito sa baranggay namin noong 2005 ata yon hindi ko matandaan anong taon.Both sides po nag agree na hatiin na lang yung 42 square meter, kaya lang walang nagka pirmahan doon sa sulat ng baranggay.Kaya yung kapit bahay namin hindi tumahimik.

May posibilidad ba na mapa sa kanila ang lupa dahil sila ang nagbayad ng buwis?.

Opo, pwede itong mapawalang bisa if the registered owner of the property would file petition for cancellation in court na walang basihan ang adverse claim po and the judge will grant if favorable to them. Bilang heirs ng inyong ama you will be notified of this action nasa inyo na po if you have sufficient evidence to prove na may right kayo sa property at hindi dapat macancel ang adverse claim ninyo. About sa kapitbahay na nag akusa na walang basihan at ang gustong gawin ay ipahiya lang kayo kailangan po ninyo itong ipablotter at sabihin nalang po ninyo na magpa assist po kayo para magfile ng criminal complaing. Sa police station may office incharge po sila para gumawa ng complaint or judicial affidavit complaint para ito po ay maifile sa office of the prosecutor. Maaring makasuhan po ng grave oral defamation nito. If sila mismo ang nagbabayad ng buwis sa 42 square meter mas malaki ang right nila kaysa sa inyo po. So pwede namang maghain muna sa barangay kung talagang may laban kayo nito baka diyan pa lang po maayos na pero kung hindi sa korte na po ito labanan na ito ng mga ebidensya po.

Hello po gusto ko sanang itanong about sa case namin, kasi po renters kami... Napagkasunduon po namin ng may ari ng lupa na magpapatayo po kami ng bahay sa lupa nila bale po lupa lang ang binabayaran namin at may kontrata din po kaming pinirmahan 5 years po yung kontrata... Ngayon po namatay na po yung may ari ng lupa at ang namamahala na ay ang anak niya. Tanong ko lang po kong mapapawalang bisa na ba ang kontrata? Maaari na po ba niyang (anak) pataasin ang singil ng lupa? Or maaari niya na po ba kaming paalisin?
Ang gusto lang po namin matapos ang kontrata tsaka na po umalis. Ano po ba dapat gawin? Salamt
