May binili po kaming lupa worth 360k bale 50 percent down payment and the rest is for 6 years to pay which is 3k per month. My concern is ang pinanghahawakan lng naming papel from them is DOS na wala pa pong notaryo kasi ipapa notaryo lng dw po yun pag naka full payment n kmi, xerox ng land title mother title po b tawag dun kasi ita transfer plng sa amin then blue print ng lupa from DENR. sapat na po ba yun mga dokumento na yun Kht walang notaryo yun DOS?

Mas mabuti sana yong notarized kasi it will bind the whole world kahit na hindi party sa bintahan. Sabagay, binding na yan between the seller and buyer. About naman sa mother title para sigurado na hindi pa ito naibenta or naisangla sa iba mas mabuting i check ang record nito sa Register of Deeds kung saan ang lupa ay nakarehistro at matatagpuan.

Nakasubdivide na yan may titled na siguro but since nakamortgage pa dahil hindi pa bayad saka na ang paglilipat ng title sa buyer after full-payment ok lang naman yan. Ang importante you keep all your evidence of payment at i check ninyo sa RD ng inyong munisipyo or maski sa office ng inyong developer if kayo na ba ang nakaassign na magbayad ng Real Property tax o ang developer pa kasi nagsimula na kayong magbayad ng hulugan yearly ang pagbabayad ng tax.

If that agreement ay nakasulat at both parties agreed ok lang yan magiging binding yan sa inyo after all hindi pa naman fully paid ang property dahil sabi mo you are paying it by installment so ang pagpapatransfer ng titulo ay gagawin once you have fully paid it already. Now, it is the burden of the contractor na magpaprocess ng titulo if yan ang pinag usapan ninyo. You can file an action against the contractor if hindi sila tutupad sa agreement na yan once fully paid na po kayo.

Salamat po kasi sbi nung iba bakit dw wala notaryo eh ang paliwanag nman po sa amin nung vendor ay dahil malaki ang babayaran na tax sa pagta transfer pag ngayon ipinanotaryo ang DOS kasi hnd p nman kmi fully paid. At sila po magpa process ng lahat ng papel yun po ang napagkasunduan both parties.

Tama yan dahil for capital gains tax kailangan bayaran ito within 30days from transaction/sale meaning the deed of absolute sale is duly notarized ngayon hindi pa namn kayo fully paid so I think yan ang pinag iisipan nila.
