May naghamon kasi ng away..Wala naman ginagawa yung taong nakaupo, karga niya yung 1 year old na anak niya nang siya e pagmumurahin at duruduruin nung naghamon. Sa sobrang galit pinaputukan niya ng baril yung naghamon pero hindi naman tinamaan. Tumawag ng swat ang naghamon. Wala naman nakitang baril ang swat bukod doon sa tama ng bala sa pader. Possible po ba na mag issue pa din ng Search Warrant ang pulis kahit 3 days na ang nakalipas?Valid pa din po ba yun kahit ilan araw na lumipas ang insidente? Wala na po ang baril sa bahay. Maraming salamat po.. sana po ay masagot ang aking katanungan...Godbless po..

Yung pag issue ng search warrant possible lang yon if yung complainant ay nag apply sa court tungkol nito in relation sa kasong naifile niya laban sa iyo. Ang korte na po mismo ang mag evaluate sa mga supporting documents, evidence, affidavit ng mga witness na magpapatunay na may probable cause na ang baril na ginamit mo ay nakatago sa specific place to be searched po or sa lugar under your control. The policemen that will conduct the search ay kailangan dala2x nila ang nasabing search warrant bago po makapasok sa bahay ninyo. Kailangang may kasama din silang mga witnesses para gawin ito usually mga barangay official ang sinasama nila or media para siya rin namang witness para sa inventory in case may makukuha po. Kapag sa tingin ng korte na walang basihan/probable cause madedeny po ang application nito.

Unang2x depende sa kaso mo kapag siguro ito lang attempted homicide maari po kayong magbail po ito lalo na if wala kang ibang pending case sa ibang korte na mas malaki pa sa kasong ito na na which is punishable by death, reclusion perpetua or life imprisonment, and the evidence of guilt is strong.
