Naka mortgage po yung 2 hectares cocoland ni tatay dun sa pinsan ko. Nito lang April 2018 madaliang pinapatubos ni pinsan kasi gagamitin na nya yung pera para sa magco college nyang anak. Inilipat ni tatay ang mortgage dun sa isang suki nya ng copra. Ang problema ngayon, hindi pala pina alam nung pinsan ko sa trabahador nya for 22 months na wala na sa kanya yung cocoland. Itong si suki ngayon, iba rin yung nilagay na taong magkokopra. Nais ngayung pagbayarin nung kinuhang tao ni pinsan si tatay kasi pinalitan daw sya. Hindi naman alam ng tatay na may usapan pala sila ni pinsan. Twice na raw silang nag usap sa harap ni barangay kapitan kaso, ayaw magbayad ni tatay kasi hindi naman siya yung nag hire tsaka ano raw basehan nila nung claims nila. Yung barangay kapitan naman daw ay parang bias dun sa mga gustong magpabayad at ayaw ipadinig sa BARC yung reklamo. Nung magpa harvest na ng mga niyog si suki nung nakaraang buwan, pinatigil ni barangay kapitan. Makatarungan po ba ito? Ano ano po ba yung maaari naming gawin sa sitwasyon na ito? Marami na rin daw naka blotter na ganitong sitwasyon dun sa barangay namin sabi nung local PNP dahil nga sa nangingi alam si barangay kapitan. At dun din daw sa DAR. Napapa isip tuloy kami na baka may patong sya dahil pinipilit nyang pabayaran para matapos na raw yung reklamo. Paki tulongan nyo po kami. Maraming salamat.

Sa tingin ko when the mortgage was released hanggang doon lang din sana ang rights ng worker na kinuha ng pinsan mo dahil wala namang consent sa tatay mo. Kaya lang sinabi mong for 22 months pinagtrabaho pa rin ninyo ang worker na yan kahit na hindi naman ang tatay mo ang naghire sa kanya so
bago nai mortgage sa iba. An employer and employee relations ay naestablish na between the worker and your tatay. You are estopped already parang ang tatay mo na rin ang nagsilbing employer niya dahil sana pinastop na ninyo agad ng isinuli na ito ng pinsan. So when your tatay mortgaged it to another at naghire din na new worker ang tatay mo ay may obligasyon na iterminate at bayaran ng separation pay dahil impliedly naging empleyado na rin niya ang taong ito for 22 months.

Ay hindi po ma'am. Bale 22 months na nasa pinsan ko yung cocoland kaya ko po nasabi na pinag trabaho sila ng 22 months. Magka sabay kasing pumunta sa abogado sina tatay, pinsan at suki nung tutubosin na. Si suki na rin ang nagbayad nung amount kay pinsan dun sa harap ng abogado tapos kinansel yung mortgage kay pinsan at gumawa ng bago kay suki na. Ni hindi nga raw dumampi sa mga palad ni tatay yung cash.
