Kapag ang biyudo po bang lalaki ay nakapagmana at nakabili ng lupa (Pinagisa na po ang lupa na mana at binili ng mapatituluhan dahil magkatabi lang naman) noong siya po ay wala nang asawa o namatay na ang unang asawa kapag po ba nagpakasal siyang muli at nagkaroon ng sila ng mga anak ay ma co-cosidered ito na conjugal property nila ng kanyang pangalawang asawa? Kahit pa kinasal sila ng effective na ang family code ngunit meron paring naiwang anak sa naunang asawa at hinihingi ang parte niya ng mamatay na ang lalaki o ama niya. Paano po ang tamang hatian na legal?

I would advice if you that property from your previous marriage at may mga anak po kayo na hatiin muna with your children bilang co-heirs before kayo mag pakasal uli dahil it will mix up with your second marriage. Magiging complicated po later on. Whatever po kasing madadalang property ninyo for the 2nd marriage will form part of the Absolute community except if before kayo magpakasal for the second time ay magkaroon po kayo ng kasunduan about your property regime na mag aaply during sa application ng inyong marriage license na separation of property po. So settle the estate of your previous marriage bago mag asawa muli ibigay mo ang nararapat sa mga anak mo.
Hindi po actually kasi property from previous marriage yung lupa. Namana at nabili na po yung lupa ng biyudo na po siya or patay na po yung una niyang asawa kaya ang nakalagay po sa title ng lupa is "Widower" at sa kanya po nakapangalan. meron po siyang naging anak sa unang pamilya niya. Hindi naman po agad pwede ibigay ang mana ng anak niya bago pa siya mag-asawang muli dahil buhay pa naman po siya. Wala rin pong naging seperation of properties dahil yung lupa rin po ang naging panimula ng lalaki at pangalawa niyang asawa. Dumating po sa point na naisanla ang lupa before pa mamatay ang may-ari (yung lalaki) tapos ang naiwang magtubos po nito ay yung pangalawa niyang asawa. After pong mamatay nang may-ari o yung lalaki, ang tanging naiwan nalang po ay yung anak niya sa first marriage, pangalawang asawa at mga anak nay sa pangalawang asawa. Magiging equal po ba ang hatian na hahatiin sa lima?
