Paano mahahati ang lupang naiwan ng tatay ko?

May naiwang lupa ang tatay ko buhay pa ang nanay ko, nakapangalan sa kanilang mag asawa ang lupa, gusto na ibigay ng nanay sa aming mga anak niya ang mga mana namin na lupa dahil gusto na ng nanay ko na maibenta ang parte niya para may pampagamot. kaso ayaw magsipirma ng mga kapatid ko para sa extra judicial partition. ano po ang dapat gawin ng nanay ko para mapakinabangan naman niya ang lupa na para sa kanya? marami salamat po

Pwede naman po ibenta lang ng nanay mo ang undivided share lang niya kaya lang dapat ipaalam din ito sa mga kapatid at sa buyer na ganito ang situation. Magpagawa nalang po kayo ng deed of sale sa isang lawyer na limited lang ang ibebenta ng nanay mo sa magiging share niya sa lupain. Ang buyer ay magiging co-owners na rin sa nasabing property. Kung maari dahil family lang naman kayo magpatawag nalang po kayo sa barangay para pag usapan ang bagay na ito. Kung talagang hindi magkasundo pa rin magpetition nalang po kayo sa korte for partition in this case you will need the services of a private lawyer para sa petition na ito.
