Ang nanay ko po ay may minanang lupa kasama niya dito ang 3 niya pang kapatid ngunit wala pa naman itong titulo, tax declaration lang po ang meron na nakalagay ang pangalan ng magkakapatid. Pwede po ba namin itong patituluhan sa pangalan lamang ng 3 magkakapatid at hindi isasama yung isa? Sa kadahilanang sinanla nang isang kapatid niya ang lupa noon at di tinubos hanggang lumaki ang utang at yung 3 magkakapatid lang ang gumawa ng paraan para matubos ulit ang lupa sa bangko.

Pwede po, kailangan lang po nila na mag execute ng Deed of Extrajudicial Settlement with waiver of rights na kung saan they will divide the property equally pero since yong isa has been benefited already out of that estate maaring he/she will waive the ownership of his/her share in favor of the other heirs. You need a lawyer po to do this and all the heirs must sign this document.
