Paano po ang paglipat ng titulo kung ang bumili at ang may ari ay parehong patay na?

Medyo kumplikado po ang nangyari.
ang may ari ng lupa ay awardee lang pero nakapangalan na sakanya ang titulo.  dahil patay na ang may ari, ang asawa niya ang nag aasikaso ng lahat ng transaction. binili ng namayapa kong  nanay yung kalahati ng lupa sa asawa ng may ari.. di pa nalilipat ang titulo saknya.  ang hawak lang namin ngayon ay papel na nilagdaan ng nanay ko, asawa ng may ari, lagda ng ibang witnesses:  NHA at ibang barangay officials at isa kong kapatid   na nagpatunay na kumpletong bayad ng nanay ko sakanila.  nakasulat doon na hahatiin ang lupa 50/50.
sa ngayon nahati na yung lupa na facilitated ng NHA pero wala na kami ibang hawak tulad ng deed of sale maliban sa nasabing agreement na nagladaan sa hatian.

Kung ganun po dahil may titulo na po ang lupa ng nakabili it means fully paid na sila. Kahit po patay na ang kanyang asawa maari pa rin kayong magpagawa ng panibagong deed of sale at ang piperma ang kanyang asawa at mga anak nalang po. Extrajudicial Settlement with Deed of Sale ang gagawin. Magpagawa po kayo sa isang abogado at ito ang basihan para po mailipat sa inyong pangalan ang titulo ang parte ng lupa na nabili. Kailangan pa po itong maipasukat para sa tamang technical description po.

maraming salamat po sa tulong niyo at medyo nakahinga na kami ng maayos. Kailangan po ba lahat ng anak niya ay pipirma sa Extrajudicial Settlement with deed of sale? yung isang anak po kasi ng may ari nasa ibang bansa..

Opo kailangan lahat ay pipirma para maiwasan na magclaim ng share ang hindi nakapirma unless mag execute siya ng waiver na hindi nalang siya hihingi ng share nito or ibibigay nalang sa kanyang mga kapatid or nanay ang kanyang share. Hintayin nalang po ninyo na uuwi siya at papirmahin ninyo sa deed of sale. Maari naman siyang mag execute ng waiver but it should be notarized kung saang bansa siya naroon.
