Paano po if gusto ko po ilipat sa apelyido ko yung anak sa una ng asawa ko?kasal na po kame,and yung biological father nya is hindi na namen nakikita at ung bata ay apelyido ng asawa ko sa pagkadalaga??do i need to need a request for the court or should i direct go to the NSO to transfer the surname of my son from her maiden surname of his mom???patulong po urgent po. Thank you,

You need to legally adopt the child bago mo mailipat ang surname ng bata. You need the consent of his father kung alam ninyo or if recognized siya ng father. Sa petition for adoption para magiging legitimate child mo na rin ang anak ng asawa mo isabay mo na lang rin ang pagpapachange ng family name ng bata. Kailangan mo ng isang abogado para sa pagprepare ng mga requirements na dapat isubmit sa korte.
