Paano po kaya makukuha ang lupa na isinanla sa iyo pero wala sa iyo ang titulo?

Sa inyo, nais ko pong ikunsulta ang tungkol sa lupa na isinanla sa tatay ko nung buhay pa siya. Ang lupa sa harapan ng bahay namin ay isinanla sa amin matagal na pero walang binigay na titulo. Pero po may hawak kaming kasulatan tungkol sa utang ng tatay nila na namatay na rin. Sa katagaltagal na panahon ay ngayon po ay binabawi na ng mga anak nila ang lupa. Ang bahay po namin ay sa likod ng nasasabing. Paano po kaya namin ito mababawi at makukuha sa kanila or ano pong dapat naming gawin

Ang maibigay na advice ko lang po dahil sanla or mortgage lang naman ang nasabing lupain the principal obligation is the payment of the debt collateral lang kasi ang lupain. Nakadepende din naman sa mga conditions na nakasulat sa nasabing agreement ang magiging right of action po ninyo. At dahil namatay na rin naman ang nagsanla at mga heirs ang gustong kumuha sa lupa may karapatan po kayong pigilan na kunin nila ito kapag hindi nila babayaran ang utang. Dapat sana pina annotate ang nasabing Real Estate Mortgage sa titulo ng lupain. Mas mabuti siguro ipatawag muna ang mga heirs sa opisina ng Barangay po ninyo para ipaalam sa kanila ang nasabing Real Estate Mortgage para if kaya nilang bayaran ang utang dapat unahin muna nila para ibigay na po ninyo ang possession nito sa kanila.
