Direct hire needs agency? United Arab Emirates

I'm about to go back to UAE next week on an employment visa. Direct hired ako but then my friend told me I cant go out of the country without employment agency..Is this true? Totoo po ba ito? Kahit po direct hire?

Hello, Dei. Actually, sa ating Labor Code, prohibited o ipinag-babawal ang direct hire kung ikaw ay OFW. Ito ay para sa iyong proteksiyon.

Una sa lahat, ang Pilipinas ay signatory sa international treaties against human trafficking kaya may ban. Kasi, ang mga human traffickers ay minsan nagpo-pose bilang recruiter o bilang isang representative ng isang employer or di kaya's employer mismo. Tapos, pag ikaw ay kasama na nila, malalaman mo na lang na prostitution pala ang business ng amo mo. So, ayaw ng gobyerno na ganoon ang mangyari sa mga Pilipino abroad kaya may ban.

May mga praktikal ding consideration kung bakit mas magandang may agency ka kung ikaw ay mata-trabaho abroad. Una, kung ikaw ay pagmalupitan ng iyong employer at wala kang agency sa 'Pinas, kung ikaw ay maka-uwi ng buhay dito, sino ang mapananagot mo para sa paghihirap mo abroad sa kamay ng iyong malupit na employer?

Pangalawa, kung ang suweldo mo ay mas maliit doon sa naka-tukoy sa kontrata mo, kanino ka maghahabla kung ikaw ay direct hire? Sa mismong labor office ng bansang iyon ka magpa-file. Papabor ba sila sa isang dayuhan o sa kapwa nila? At kung sabihin na nating hindi mo matagalan ang kakarampot na suweldo, at ikaw ay umalis sa boss mong iyon, kanino mo ike-claim ang unpaid or underpaid salaries mo? Kung may agency ka, sa 'Pinas mo puedeng idemanda iyong agency kasi, ang agency ang tatayo sa lugar (agent nga siya) noong iyong balasubas na employer.

Pangatlo, kung ikaw ay tanggalin ng walang just cause sa iyong trabaho at ikaw ay mapilitang umuwi, sino ang puede mong idemanda sa maling pagkaka-tanggal sa iyo mula sa trabaho? Kung may agency ka, sa 'Pinas puede mong idemanda ng illegal dismissal ang agency mo. Ang agency ang tatayo bilang employer mo at sila ang mananagot sa maling pagtatanggal ng employer mo sa iyo.

Yan ang mga benepisyo nang umalis sa bansa bilang OFW na may agency at hindi direct hire. Sa isang banda, walang babayarang placement fee at hindi ka magkaka-utang-utang. Walang salary deduction para sa mga nagastos para ikaw ay umalis. maganda lahat iyan. Pero, sa kabilang banda, mapanganib ang maging isang OFW na dayo sa isang lugar na wala kang kamag-anak o kaibigan. Sapalaran talaga at risky. Isipin mo ang mga bagay na ito bago ka magpasya kung aalis ka nga ba sa ilalim ng direct hire na contrata.
