May nautangan po yung friend ko and nakapag issue siya ng cheke na mismong lending yung nagpa open sa bangko. Nakapag hulog siya sa cheke niya ng 2 beses kaso po nagka emergency and d niya napunduhan yung cheke worth 3500. After ilang months po nag try siya mangutang sa iba po gamit yung same cheque at hindi na din niya nabyaran. May natanggap po yung parents niya na subpoean doon sa una pero doon sa pangalawa wala po siya natanggap. Now, after 5 years po nag try siya kumuha ng nbi and may hit siya and may nakpag sabi sa kanya na may warrant of arrest po siya and for interview po siya sa quality control sa nbi main.
Question po.
1. Safe po ba na pumunta siya for interview sa quality control kahet alam po niya na may warrant po siya?
2. If d po safe, pwede po ba authorized rep niya pumunta with the authorization letter?
3. Plano din niya po kasi i-setttle yung balance niya pero installment para lang ma clear yung nbi niya. Question po is maki clear po ba nbi niya pag nabayaran na niya yung utang niya? Thanks po sa sasagot.

Magpapadala ng Subpoena ang Prosecutors office kung may nagpapafile ng complaint at ito ay ipapadala sa current address or last known address mo. Maaring hindi ito natanggap or hindi natagpuan sa address na pinadalhan kaya naifile na ang kaso sa korte. If may warrant of arrest already talagang arestuhin ka sa NBI authorities unless magpopost ka ng bail. Mabuting humingi ng impormasyon sa NBI kung saan korte ito nakafile para magpost ka ng bail doon para hindi ka madakip. Hindi pwede ang representative para kumuha ng NBI personal appearance and required. Kung gusto mong macleared ang record sa NBI you have to settle the obligation in court at humingi ng court clearance na ito at nadismiss na.
So pwede po yung person mismo yung pumunta sa NBI para malaman kung saang court yung ngkaso sa kanya kahet alam po niya na may pending warrant po siya? Hindi po siya huhulihin sa nbi pag nalaman na siya yun? Gusto na rin po niya ma-settle yung issue pero natatakot po siya pumunta ng nbi. Hindi po ba pwdeng iba ang pumunta para sa kanya para ma-check po kung saang court nai file yung kaso. Thanks po

Kapag pumunta ka sa NBI talagang arestuhin ka mas mabuting magdala nalang po kayo ng kasama para incase po you will be arrested may tutulong sa iyo maghanap ng pambayad sa bail kung bailable ang crime. Hindi naman po pwede ibang tao ang magtatanong sa kaso laban sa iyo dahil personal information at covered ng data privacy yan. If I were you pwede po kayong magtanong sa Office of the Prosecutor kung saan naganap ang crime dahil may information naman po sila kung saang korte naraffle ang kaso mo. Magpost ka ng bail doon at isettle mo bago ka kumuha ng NBI clearance kapag may court clearance ka na ring dala na settled na ang kaso mo in that way makakakuha ka na ng NBI clearance.
