Good day po.. May nabili po kami lupa ng kasama ko sa trabaho..Dalawa po kami nakapangalan sa deed of sale and nasa akin po lahat ng original TCT at docs n kailangan po pati narin po yung relocation plan na paano hati ng lupa..May dalawa po kami prinoduce na Deed of sale isa original na amount at isang 500k na sana ggmtn para sa transfer dahil sa mataas ang tax babayaran sa BIR. napanotaryo n po naman yung 500k na deed of sale 2019 pa po..Currently yung original Deed of sale tinago po niya yung 2 copy and iisa na lang natira sa akin..since balak ko po sana asikasuhn yung paglipat ng kanyaknya titulo..Ayaw niya po ibgy sa akin at aminin n asa kanya 2 copy ng original deed of sale worth 1.3M. Pwede ko po bang gmtn yung nttra isang copy sa pgpapatransfer ng separate TCT?..at yung survey plan na subdivided at certificate po at nawawala rin sabi niya wala sa kanya..Dahil po sa problema na yn d ko matransfer kaya gusto ko sana ibenta na lang yung hati ko sa lupa..Pwede ko po ba ibenta sa bangko yung hati ko since iniipit ako ng kahati ko sa lupa.. If the Deed of Sale was notarized on 2019 nabayaran na po ba ninyo ang Capital Gains at Doc Stamp nito? After 30 days from date of notarization mag interest/penalty na kayo sa babayan at BIR . So if wala pa baka sakaling makikita pa ninyo ang Seller sabihin ninyo na icancel nalang ang old na Deed of Sale at gawa na lang kayo ng bago para hindi naman malaki ang babayaran ninyong penalty sa BIR. Kung wala na po kayong contact sa Seller, yung old Deed of Sale na gagamitin with penalty na yan. Now, if hindi ka niya bibigyan ng copy sa Deed of Sale na hawak niya, you can ask for the Certified True Copy of the said Deed of Sale sa Notarial Division kung saan nakaregister ang lawyer na nagnotarized sa nasabing document you can still use the Certified True Copy to process the titling po however since dalawa kayong owners gagawa pa kayo ng Deed of Partition para magseparate kayo at ibenta ang share mo or else kayong dalawa pa rin ang mailagay sa title at you need his consent kung ibenta ito.
