Puwede po ba ipagbili ang bahay na nasa lupa ko?

Nakatira po kami sa tabi ng riles at inaward na po saamin ang lupa na kinatatayuan ng bahay namin. Nababakuran po ang lote ko kasama ang kaunting portion ng abandoned semetery sa  likod namin. Ngayon, nakitayo ng bahay ang kapatid ko sa bandang likod ng lote ko. 2/3 po ng bahay niya ay pasok sa lupa ko. Yung 1/3 po sa bandang kusina ng bahay niya nakatayo naman sa lupa na sakop ng abandonadong sementeryo. Ngayon po ay gusto nang umalis ng kapatid ko at gusto ibenta ang bahay sa ibang tao. Sabi po namin, hindi niya pwedeng ibenta sa iba dahil nakatayo ang bahay sa lupa namin. Ang sagot niya po ay hindi namin pag aari ang lupa na dating sementeryo. Ano po ang karapatan namin attorney?

Kung ang bahay niya ang nakatayo sa lupang naiaward na ng gobyerno sa inyo at ang pagtayo niya nito ay by tolerance lang meaning pinapayagan mo lang habang hindi mo pa ginagamit ang lupa wala po siyang karapatang ibenta sa iba ng walang pahintulot po sa inyo. Wala naman po siyang hinahawakang rights sa nasabing lupain. Ang tanging karapatan lang po niya ay maaring gibain niya ito at kunin ang mga nasabing materials provided hindi ito makapagdulot ng damage sa lupain. O kaya may karapatan kang ibenta sa kanya ang portion ng lupa na kinatatayuan po ng bahay niya. Mas mabuti pong mag usap kayo sa barangay para mapaalis po ninyo ang kapatid ninyo ng walang gulo.
