Pwede pa ba baguhin ang hatian ng lupa sa Extra Judicial (notarized)?

May land property po ang lola ko na nakatitulo sa kanya at sa 2 niyang anak. Tag 1/3 silang tatlo. Nakasulat po yan sa TCT. Meron siyang 6 na anak. 4 sa kanila ay hindi nakasama sa titulo. 2 sa apat na yan ay walang pamilya at patay na. The other 2 ay pamilyado pero patay na rin. Dahil sa namatay na ang lola ko, nagkaron ng Extra Judicial Settlement para maipamana yung 1/3 share niya papunta sa pamilya ng 2 anak niyang hindi nakasama sa titulo. Dahil sa wala kami alam sa mga legal matters na ganito, ngayon namin narerelealize na dapat equal share ang ngayon ay apat na nag hahati hati sa lupa. Pwede pa ba baguhin ang hatian kung may notarized Extra Judicial na at lalo kung may party na hindi pabor sa equal share? Note: Sa 3 original owners, 1 nalang po ang buhay, which is mother ko. Ang lola ko ay patay na. Ang panganay na kasama sa original ay patay narin kaya sa Extra Judicial ay heirs na niya ang nakalagay. Bale yung monther ko at heirs ng panganay ay nag waive narin ng share sa portion ng lola ko. Sana po ay makakuha kami ng idea. Salamat.

Since Extrajudicial Settlement and Declaration of Heirs lang naman ang ginawa ninyo then you can cancel it and make a new lalo na if the said Extrajudicial Settlement ay hindi pa ginamit for the issuance of the respective title mas madaling baguhin. However, ang concern po dito if papayag po ba sa sharing ang ibang heirs. Sa sinabi po ninyong na sa TCT ang lola at 2 anak lang ang nakasulat baka may consideration kung bakit dalawang anak lang po ang nakalagay baka binili po nila ito sa lola ang portion ng nasabing property. So, if that's the case the equal sharing po will not apply. Dapat ang equal sharing lang sa 1/3 if yan ang condition you have to trace the facts of this case.
