Tama po ba ihold ang passport ng isang travel and tours agency?

Nais ko po sanang humingi ng payo dahil umano ng August 20 po ako nag subok mag apply sa isang travel and tours ng visa application papuntang china umabot na po sa 2 month ang application at wala pa din pong nangyari tourist visa lang po ang inapply ko at sabi po ng agent ay nirefile daw po nila ang aking application at nakapagdecide po akong ipull out and passport ko gawa po sa subrang tagal ng proseso at ngayon inohold nila passport ko at pinagbabayad ako ng 38k para po makuha ang passport ko may pinapapermahan saking acknowledgement na para pong agreement once na hindi ako magbayad ng 5000RMB pinsan ko daw po na nasa china ang magbabayad.. una sa lahat po napag isipan kong ipull out dahil para po kasing pera lang habol nila at napag isipan ko na din wag sumugal na lalabas ako bilang isang TNT sa china kaya po ngayon po once na nagperma ko sa acknowledgement means pinsan ko po magbabayad ng 5000RMB sa tingin po ba tama po ginagawa ng isang Travel and tours lang at wala namang kakayahang magrecruit atmaghanap ng employer sa ibang bansa pero yon po ay ginagawa nila na mag hold ng passport sana po ay masagot nyo katanungan ko salamat po

Ang mga travel agencies ay hindi pinapayagan ng ating batas na magrecruit ng mga ofw workers so pwede po ninyo silang mareport sa POEA/DOLE kung yan ang purpose niya why your passport was being held. Unlawful din yang ang pinsan mo ang magbabayad sa transaction na hindi naman siya involve. Try to negotiate na makukuha mo ang passport mo at bayaran mo nalang at a reasonable amount ang nagasto nila kung sakaling magback out ka for your tourist visa application provided they can produce the receipts and other proof na yan ang nagasto nila. Kung hindi you send them a demand letter ask the help form a private lawyer or PAO para mapadalhan ng demand letter at makukuha ang passport mo. Pwede ring sa POEA ka magreport at sila na mismo ang mag investigate lalo na that said travel agency is involve in recruitment.
